Terms of Use for Campus by Mersys

1. Acceptance of Terms
By accessing and using the Campus by Mersys SaaS application ("Campus by Mersys"), you agree to comply with and be bound by these Terms of Use. These terms govern your use of the application and the services provided by Mersys. If you do not agree to these terms, you should not use the application.
2. User Accounts and Responsibilities
Account Creation: Users (school administrators, teachers, students, parents) may be required to create an account to access certain features of Campus by Mersys. You agree to provide accurate and complete information during registration and to update your information as necessary.
Google Account Integration: If you choose to integrate your Google account with Campus by Mersys, you are responsible for maintaining the security of your Google account and managing the permissions granted to Campus by Mersys.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You must notify Mersys immediately of any unauthorized use of your account.
3. License to Use
Campus by Mersys grants you a non-exclusive, non-transferable, limited license to use the application in accordance with these Terms of Use. This license is for personal or educational use only and does not allow for commercial exploitation.
4. User Conduct and Obligations
Prohibited Activities: You agree not to use Campus by Mersys for any unlawful purpose or in violation of any local, state, national, or international law. Prohibited activities include, but are not limited to:
Engaging in unauthorized access to the Campus by Mersys system.
Transmitting harmful, defamatory, or otherwise objectionable content.
Interfering with the operation of the application or disrupting the experience of other users.
User-Generated Content: You are solely responsible for any content you submit, post, or display on Campus by Mersys. You agree not to post content that is illegal, offensive, or violates the rights of others.
5. Intellectual Property
Ownership: All content, features, and functionality of Campus by Mersys, including but not limited to text, graphics, logos, software, and data, are the exclusive property of Mersys or its licensors and are protected by intellectual property laws.
User Content: Any content you submit, post, or display on Campus by Mersys remains your intellectual property. However, by submitting content, you grant Mersys a worldwide, royalty-free, and non-exclusive license to use, distribute, reproduce, and display such content as necessary to provide the service.
6. Privacy and Data Protection
Your use of Campus by Mersys is governed by our Privacy Policy, which can be found in Privacy Policy. By using the application, you consent to the collection, use, and processing of your information as described in the Privacy Policy.
7. Google Services Integration
Campus by Mersys may integrate with various Google services to provide enhanced functionality. By using these integrated features, you agree to the following:
Google Account Permissions: You grant Campus by Mersys permission to access your Google account information as necessary to provide the integrated services. You can manage these permissions through your Google account settings.
Compliance with Google Policies: You agree to comply with Google’s terms of service and privacy policies when using any Google services integrated with Campus by Mersys.
8. Disclaimers and Limitation of Liability
Disclaimer: Campus by Mersys is provided "as is" and "as available" without warranties of any kind, either express or implied. Mersys does not guarantee that the application will be uninterrupted, error-free, or secure.
Limitation of Liability: To the fullest extent permitted by law, Mersys shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of Campus by Mersys, even if Mersys has been advised of the possibility of such damages. In no event shall Mersys’s total liability to you for all claims exceed the amount paid by you, if any, for accessing Campus by Mersys.
9. Termination of Use
Termination by Mersys: We reserve the right to suspend or terminate your access to Campus by Mersys at any time, with or without notice, for any reason, including but not limited to a breach of these Terms of Use.
Effect of Termination: Upon termination, your right to use Campus by Mersys will immediately cease. All provisions of these terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, and limitations of liability.
10. Modifications to the Terms of Use
We may update these Terms of Use from time to time. Any changes will be effective immediately upon posting. Your continued use of Campus by Mersys after the posting of revised terms constitutes your acceptance of the changes.
11. Governing Law and Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of the State of New Jersey. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts located in the State of New Jersey. You agree to resolve any disputes with Mersys through individual arbitration, and you waive the right to participate in any class action or class-wide arbitration.
12. Third-Party Links and Resources
Campus by Mersys may contain links to third-party websites or resources, including Google services. These links are provided for your convenience only, and Mersys is not responsible for the content, products, or services available from those websites. Your use of third-party websites and services is at your own risk and subject to the terms and conditions of those websites.
